ACC Ranch Poodle Contract

The intent of this contract is to assure that the dogs produced by us will receive appropriate care and will be protected from indiscriminate owners.

Therefore the buyer agrees to provide all necessary veterinary services, will protect from injury and will not allow the animal to roam free in the community. Buyer shall maintain the dog in a fenced in area with adequate shelter or inside home with regular exercise.

The buyer agrees to pay $________ at a time of choosing their puppy, to reserve the right to purchase this puppy, this will be a deposit towards the purchase price of $_______ for the puppy. The balance to be paid 1week prior to shipping or at the time of pickup. This animal and registration papers applying to this animal will remain the property of the seller until final payment is made.

Every effort has been made to ensure that the puppy you've selected is healthy at the time of purchase. To keep the guarantee offered to you in force, you must have your puppy examined by a licensed Veterinarian of your choice NO LATER THAN 5 BUSINESS DAYS from the date you receive your puppy. During the initial exam should your veterinarian find the puppy to be a poor health risk or detect any physical health issues that would require further veterinary care other than required immunizations and/or treatment for any type of parasite or bacteria whether internal or external YOU MUST CONTACT US WITHIN 48 HOURS. We recommend taking a fecal sample into your vet the first time you take the puppy to the vet.

There is no guarantee of temperament, fertility, show quality, size, coat quality, patellas, color, bite, ears, molera, testicles, hernias, calcium drops, hypoglycemia, allergies or skin problems. This puppy is sold as pet quality.

If this puppy dies before one year of age, then the body must be autopsied. If the cause of death was due to a genetic birth defect, then seller will replace the puppy with one of equal quality as soon as one becomes available. SELLER WILL NOT REFUND PURCHASE PRICE OR BE RESPONSIBLE FOR VET BILLS.

A diagnosis of Coccidiosis, Giardia, parasites or any other bacterial infection does not render your puppy unhealthy. This guarantee does not cover the above mentioned conditions. No veterinarian fees charged for the initial exam or any other veterinary services will be paid by the seller! If you neglect to take your puppy to a veterinarian for this initial examination, you will accept immediate and full responsibility for its health and this guarantee will be voided! In accordance with the above, we also guarantee your puppy for a full (7) seven days from the date of possession against Parvovirus, Distemper, and Hepatitis. In the event your puppy does not pass the initial exam or contracts any of the aforementioned,

The puppy and all related materials must be returned to the seller accompanied by a legible written and signed veterinary report, a complete history, lab report(s) and or pathology report from a licensed lab. If your puppy is diagnosed with Parvovirus, and IGG and IGM Blood Antibody Titer Test must be done with results furnished to the seller. Should your puppy die from either Parvovirus or Distemper, we will replace your puppy with the first available puppy of the same breed and sex, however NO PART OF THE PURCHASE PRICE WILL BE REFUNDED!

In addition, your puppy may be returned should he/she develop a life threatening congenital defect.

The puppy is guaranteed for one year against eye retina displacement, thyroid & heart disease, patellas requiring surgery. Severe genetic hip dysplasia is guaranteed for 2 years. (Other hip and joint problems can be caused by overfeeding; not maintaining proper weight; not feeding quality food; over exercising & other factors that would be out of our control when in developmental stages) The guarantee is to return & replace the dog at the expense of the buyer. The disease must be confirmed to our veterinarian and by a licensed veterinarian. Upon our veterinarian's confirmation we will honor the guarantee. The cost of veterinarian visits and all shipping costs are the buyer's responsibility.

At no time will the puppy be replaced without said puppy being returned to seller. Puppy is further guaranteed to be free of life threatening congenital defects until the date of its second birthdate. In the event such defects are confirmed by two unassociated veterinarians, a replacement puppy shall be given under the same terms listed above. In the event that the puppy becomes ill or dies in the breeders care after a deposit or payment has been made, seller agrees to give the buyer choice puppy from the next available litter as soon as one becomes available.

Again, if, at OUR DISCRETION, we decide that we can not provide you with a suitable replacement, we will refund your "purchase price of the puppy". The buyer accepts complete responsibility for the health and well being of this animal from date of possession and agrees that loss, death or disablement of this animal shall in no way nullify, lessen or alter his obligation to the seller under the terms of this contract. The seller guarantees this animal to be the breed specified at sale, and registered or registerable, unless otherwise specified herein, and to be free of any liens or encumbrances resulting from terms of the stud contract, veterinary fees, leases or co-ownerships. Seller guarantees that all shots are current, and deworming completed as noted on puppy health records.

All puppies at ACC Ranch are sold on a Limited Registration, all puppies must be spayed/nuetered before they reach 6 months of age. If you are requesting Full registration, please do let us know. This is a different contract. We will, on occasion, offer full registration to responsible owners, again, just let us know your situation.

The buyer agrees that, should he ever decide to part with this dog, the buyer must contact the seller, the seller has the first right of refusal for the dog. . Should the buyers situation change in that he can no longer care for this dog, he must notify the seller immediately. The seller will take the dog back or assist in finding a suitable home for it.

IF the puppy does not work out at your home within the first 5 days, the buyer will take the puppy back, there will be a minimum 25% service charge.

AT NO TIME will this dog be surrendered to a shelter or humane society. The seller will always assist in placing this dog. The buyer agrees that, should he not meet any and all terms of this agreement, the seller may repossess this animal, after giving five days written notice. The buyer agrees to pay any lawyers fees, court costs, traveling and shipping expenses, and other miscellaneous expenses incurred by the seller in repossessing this animal. Buyer agrees that any further transfers of this dog are bound by this agreement. Seller certifies that all statements made in this contract are true and correct to the best of her knowledge.

Buyer and Seller agree that this contract will be governed by the laws of the State of Colorado and may not be altered, modified or rescinded unless agreed to in writing by Buyer and Seller.
